This Privacy Policy applies to all information received by Nikon Inc. (“Nikon,” “we,” “our” or “us”) through various on-line and/or off-line points of communication (collectively, the “Communication Points”), including but not limited to the following:

(a) this Nikon website and any other Nikon websites including any of its microsites or subsites (collectively, “Nikon Owned Websites”).  Nikon Owned Websites are the property of Nikon or its licensors;

(b) Nikon’s social media pages on Non-Nikon Owned Websites, as defined in Section 6  below (e.g., Nikon’s official/verified pages on Facebook, Twitter, YouTube, Instagram, Google+, Flickr and/or Vimeo), which post a link to a Nikon Owned Website containing this Privacy Policy; and

(c) Other electronic, in-person, hard copy written or other means by which you may provide us with information, such as by purchasing products from Nikon’s on-line store, by participating in Nikon-related contests, sweepstakes and/or other promotions, by redeeming a Nikon-related offer, by communicating with Nikon at trade shows or events, by registering and/or attending Nikon School sessions and events, by presenting products for service, and/or by registering your product.

1. Our Commitment to Privacy
Nikon recognizes that the protection of information that it receives from you is very important. Collecting information allows Nikon to better understand and to be more responsive to you, as well as to develop and maintain websites relevant to your needs, and assists us in managing our business better. To better protect your privacy, we provide this notice explaining our information practices and the choices you can make about the way your information is collected and used. 

If you are a California resident, you may, one time per calendar year, request a notice regarding the categories of personally identifiable information disclosed by Nikon (if any) during the immediately preceding 12-month period to third parties for their own direct marketing purposes, and the name and address of any such third parties.  To obtain such a notice, please send a written request by postal mail to Nikon Inc., 1300 Walt Whitman Road, Melville, New York 11747, Attention: Legal Department.

3. The Information We Collect
We collect both Non-Personally Identifiable Information and Personally Identifiable Information, each defined below, that you provide to us through the Communication Points.   

Non-Personally Identifiable Information is information that cannot be used to identify you or to contact you and is information not associated with a specific personal identity. It includes information that we (or our third party service provider) collect automatically from you by tracking your use of the Nikon Owned Websites, using technology and methodology that enables tracking, such as cookies, pixels, web beacons, log files and other tracking technologies (collectively, “Cookies”).  A Cookie is a small file of information sent by a web server to store on a web browser so it can later be read back from that browser.  Information that a Cookie collects may include but is not limited to information such as domain type, browser version, service provider, internet protocol address, time spent and web pages visited, as well as information searched for on our Nikon Owned Websites. Cookies help a website recognize a returning visitor for purposes of saving certain preferences that the visitor set while previously browsing the website. This tracking through the use of cookies will not by itself reveal anything to us about you personally or provide us with any information that personally identifies you, such as your name, e-mail address or other personally identifiable information. Non-Personally Identifiable Information may also include information that you, at your option, voluntarily provide us through any of the other Communication Points and includes but is not limited to information such as your hobbies and interests, gender, age, level of education, photographic skill level as well as your purchases of and your experience with our products. 

Personally Identifiable Information is information collected from the Communication Points that is associated with a person’s name or personal identity and can be used to identify or contact you. It includes but is not limited to such information as your name, postal address, e-mail address, telephone number (mobile and/or landline), fax number, and credit/debit card information. We do not knowingly collect Personally Identifiable Information from children under the age of thirteen. 

4.  How We Use Collected Information
Nikon uses collected information (both Personally Identifiable Information and Non-Personally Identifiable Information) to provide you with the goods, services or information that you request, and also to help us better understand the needs and interests of consumers so that we may more closely meet your needs.  For example, we may use Personally Identifiable Information to help you complete a transaction or order with us, to respond to your inquiries and requests, to provide and update you on our customer services and support, to notify you of promotional or special offers, to communicate with you about our products and services, to allow you to participate in an interactive feature, to invite you to participate in surveys about our products and/or services, to send you information about Nikon products, services, promotions, events, firmware or software updates, and service advisories, to suggest how to get more enjoyment from your Nikon products and photography, to post reviews or comments that you have submitted to Nikon, and/or to help us determine other Nikon products, services or information that may be of interest to you (see Section 12 below, “Your Privacy Preferences Regarding Personally Identifiable Information-Opting In/Out” regarding communications to you). Personally Identifiable Information in the form of credit/debit card information is used only for payment processing and fraud prevention.

We use Non-Personally Identifiable Information to increase the functionality and user friendliness of our Nikon Owned Websites, to improve the design, content and visitor experience of all of our Communication Points, and/or to deliver interest-based advertising as described in this Privacy Policy (see Section 7 below, “Online Behavioral Advertising” regarding interest-based advertising). We may also use Personally Identifiable Information and/or Non-Personally Identifiable Information for research purposes such as analyzing how visitors use and navigate our Nikon Owned Websites. In addition, we may take your Personally Identifiable Information and make it Non-Personally Identifiable Information, either by combining it with information about other individuals (aggregating your information with information about other individuals), or by removing characteristics, such as your name, that make the information personally identifiable to you, i.e., de-personalizing your information. Given the nature of this information, there are no restrictions under this Privacy Policy on Nikon’s right to aggregate or de-personalize your Personally Identifiable Information, and use and/or share with third parties the resulting Non-Personally Identifiable Information in any way.   

5. Who We Share Information With
Nikon may disclose Personally Identifiable Information to companies affiliated with Nikon, such as our parent company and/or unaffiliated third parties working on our behalf or for us or with us, such as agents, service providers, consultants, shippers, processors, vendors and suppliers, for the purposes of enabling them to respond to your requests to us or your purchase of products, services or information, for fulfilling Nikon-related contests, sweepstakes, promotions and/or Nikon-related offers, assisting us in understanding your needs and interests so that we can better provide you with products, services or information, or for the other purposes discussed above in Section 4 of this Privacy Policy. All such affiliated and unaffiliated parties who have access to Personally Identifiable Information are required by Nikon to keep confidential such information and may not use it for any purpose other than to carry out the services they are performing for Nikon and as otherwise required by law. Except as otherwise stated in this Privacy Policy, Nikon will not share Personally Identifiable Information with third parties without your permission, unless to (a) comply with any law, subpoena, regulation or court order; (b) respond to requests from governmental authorities; and/or (c) help prevent fraud or to protect the safety, rights, property or security of Nikon as well as that of third parties. 

6. Links to Non-Nikon Owned Sites
The Communication Points may include links to and/or from other websites and/or social media platforms which are not owned by Nikon and are owned by companies or parties which are either affiliated or unaffiliated with Nikon (collectively, “Non-Nikon Owned Websites”). These links are provided to you as a matter of convenience and for informational purposes only.  When you access links to or from a Non-Nikon Owned Website, you are not on a Nikon Owned Website. We do not endorse or make any representations about Non-Nikon Owned Websites, and we are not responsible for and we disclaim all warranties, express or implied, as to the practices, privacy, content or security of such Non-Nikon Owned Websites.  You are responsible for reviewing, and we encourage you to review the terms of use, privacy and any other policies of such Non-Nikon Owned Websites. 

7. Online Behavioral Advertising
Nikon may participate in targeted advertising, whereby you may receive advertisements that may be of interest to you on Nikon Owned Websites and/or Non-Nikon Owned Websites from Nikon, third party advertisers or advertising networks. These advertisements are selected based on an assessment of your on-line browsing behavior, search activities and/or demographic information.  We do not share Personally Identifiable Information for this purpose.
If you receive a behaviorally targeted advertisement as stated above, you may click on the icon displayed on the advertisement to receive more information, including instructions for opting out from receiving further advertisements from that particular advertising network.  Your opt-out choices may depend on your specific device or browser settings and some websites or browsers may have different features regarding your ability to choose which ads to display or opt out from receiving.  Please refer to the applicable website that you are visiting for additional information. 
For ad networks or other third parties who follow the Digital Advertising Alliance’s (“DAA”) Self-Regulatory Principles for Online Behavioral Advertising, or who are members of the Network Advertising Initiative (“NAI”), you can opt-out of receiving targeted ads from such parties by visiting the opt-out pages on the DAA website at and/or the NAI website at

8.  Do Not Track Signals
Some web browsers may have a “do not track” option that allows you to opt out of having your on-line activities tracked.  As a uniform technological standard has not yet been developed regarding this technology, the Nikon Owned Websites are not currently set up to respond to this feature, and we do not take action to respond to such “do not track” signals.

9. Our Commitment To Information Security
Information security is important at Nikon, and while no security measure is perfect or impenetrable and we cannot guarantee the security of the information that you provide to us, you can be assured that we maintain physical, electronic and administrative measures and safeguards and periodically review these security measures and safeguards to protect your Personally Identifiable Information from unauthorized or inappropriate access and use.  

10. Our Commitment To Children's Privacy
Our Communication Points are not directed at minors, and we do not knowingly solicit or collect personal information from or about children under the age of thirteen. Should any parent or guardian discover that his/her child has provided personal information to Nikon, please contact Nikon at to have such information deleted from our records.  

11. How To Access or Update Your Information
You can access, edit, delete and update any Personally Identifiable Information that you provided to us by visiting your profile page on (if you are a registered user) or by contacting us at  We use this procedure to better safeguard your Personally Identifiable Information.  To protect your privacy and security, we will also take steps to verify your identity before granting you access to edit or update your Personally Identifiable Information.  

12. Your Privacy Preferences Regarding Personally Identifiable Information-Opting In/Out
You can opt out of receiving promotional communications from Nikon by notifying us that you do not wish to receive such information by contacting us at Nikon Email Preferences (if you are a registered user), by contacting us at, or by contacting us in writing at Nikon Inc., 1300 Walt Whitman Road, Melville, New York 11747, Attention: Senior Manager, Customer Relations.  Please note that if you have opted out of receiving promotional communications from us, Nikon may still send you non-promotional communications (such as, for example, information about your accounts or purchases).  In addition, in the event you have opted out but in the future desire to receive promotional information from Nikon, you may opt in by contacting us at Nikon Email Preferences

13. Changes To Privacy Policy
By visiting any of the Communication Points, or otherwise providing Nikon with your information, you are subject to this Privacy Policy and thus consent to our collection and use of your information as set forth in this Privacy Policy. Nikon reserves the right to modify or supplement this Privacy Policy, including our collection and use and related business practices, at any time by posting updated text on our Nikon Owned Websites, however we will not materially reduce your rights under this Privacy Policy with respect to previously provided information, without your consent.  Changes to this Privacy Policy are effective at the time they are posted to our Nikon Owned Websites.  For this reason, it is your responsibility and Nikon encourages you to review this Privacy Policy each time you visit any of our Nikon Owned Websites.

Nikon’s Follow Your Passion Video Contest

Official Rules

No purchase necessary. A purchase or payment of any kind will not increase your chances of winning.

1. Eligibility: Nikon’s Follow Your Passion Video Contest (the “Contest”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of Nikon Inc., Don Jagoda Associates, Inc., and any of their parent and affiliate companies and their respective advertising, promotional and/or other agencies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

3. Agreement to Official Rules: Participation in this Contest constitutes the entrant’s (“you,” “your” or the “Entrant”) full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to this Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. Timing: The Contest begins on May 15, 2019 at 12:00 a.m. Eastern Time ("ET") and ends on October 31, 2019 at 11:59 p.m. ET (the "Contest Period"). Sponsor's computer is the official time-keeping device for the Contest.

5. How to Enter: To participate in this contest you must (a) have or be willing to open a YouTube or Vimeo account (an "Account"), and (b) have access to a Nikon Z 6 or Nikon Z 7 digital camera (a “Nikon Z-Series Camera”) and NIKKOR Lens. Your Account settings must allow for your video to be public and thus viewable by the Sponsor and its agents. If you do not have an Account, you can create one for free by visiting or Each Account is subject to its Terms of Use: https://// and https://// Neither YouTube nor Vimeo is associated with this Contest.

During the Contest Period, visit (the “Contest Website”) and:

1. Follow the links and instructions to complete and submit the registration form, including your name, telephone number, email address, a valid home address (P.O. Boxes are not permitted), the model of camera and lens used for this Contest, and other information requested by Nikon (collectively, the “Registration Information”);

2. Upload to your Account a 3-5 minute cinematic video piece taken by you using a Nikon Z-Series Camera and NIKKOR lens, the theme of which is “Passions” and which video best conveys your expression of your creative passions (the “Theme Video”). Then, follow the directions on the Contest Website to copy and paste to the Contest Website, the URL that links to the Theme Video posted on your Account; and

3. Upload to the Contest Website, one (1) unedited still image shot with a Nikon Z-Series Camera and NIKKOR lens, of a scene from the Theme Video that was taken during the filming of the Theme Video, which unedited image includes the EXIF data verifying that the camera used to capture it is a Nikon Z-Series Camera (the “Unedited Image”).

The Registration Information, Theme Video, and Unedited Image are all required to enter this Contest and are hereinafter collectively referred to as your “Submission.” Submissions will be accepted only until October 31, 2019. By uploading your Submission, you represent, warrant and agree that your Submission is true and correct and conforms to the Video Guidelines and Content Restrictions as defined below (collectively, the “Guidelines and Restrictions”) and that Sponsor, in its sole discretion, may remove your Submission and disqualify you from the Contest if it believes that your Submission fails to conform to the Guidelines and Restrictions.

Video Guidelines:

  • The Theme Video must be provided in the form of a URL that links directly to the video on Entrant’s Account;

  • The Theme Video must have been both produced and posted to Entrant’s Account on or after May 15, 2019;

  • The Theme Video and the Unedited Image must be taken using a Nikon Z-Series Camera and NIKKOR lens;

  • The Theme Video must not exceed five (5) minutes in length; and

  • The Theme Video cannot have been submitted previously in a promotion or contest of any kind.

Content Restrictions:

  • The Submission must be in the English language.

  • The Submission must not contain audio or an audio track for which the entrant does not have written permission from the owner thereof to use for this Contest (see below regarding “Permissions”).

  • The Submission must not contain material that violates or infringes another’s rights, including but not limited to trademark, privacy, publicity or other intellectual property rights, or that constitutes copyright infringement;

  • The Entrant must have written permission from all individuals that appear in the Submission (if any) for Entrant and its licensees and designees to use their name, image, appearance, performance and/or likeness in the Submission and to grant the rights set forth in these Official Rules (see below regarding “Permissions”);

  • The Submission must not disparage Sponsor, Administrator or any other person or party affiliated with the Contest;

  • The Submission must not contain brand names, logos and/or trademarks (other than those owned by Sponsor, which Entrant has a limited license to use to incorporate in his/her Submission solely for purposes of this Contest);

  • The Submission must not include any appearance or representation of celebrities, athletes, musicians; any URL addresses; and/or the names, addresses, phone numbers, email addresses of third parties;

  • The Submission must not contain viruses, Trojan horses, worms, bots, spyware or any other computer code that is intended to or does damage, interfere with and/or surreptitiously intercept or expropriate any system, data or information.

  • The Submission must not contain video, images or artwork not created by Entrant;

  • The Submission must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous;

  • The Submission must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and

  • The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where Submission is created.

Limit: Each Entrant may upload a maximum of one (1) Submission during the Contest Period. Submissions received from any person or email address in excess of the stated limit will be void. Submissions generated by script, macro or other automated means are void. Entrant must be the sole creator and owner of and possess all rights in and to the Submission, have secured written, royalty and payment-free rights of property, privacy, publicity, model, talent, music, intellectual property and/or other releases, waivers, permissions and/or licenses to use all names, audio, locations, property and/or likenesses in the Submission and to grant the rights set forth in these Official Rules to Entrant and/or its licensees and designees, from all persons, images and property, if any, appearing in the Submission (collectively, the “Permissions”). If requested, Entrant must be able to provide such Permissions to Sponsor in a form acceptable to Sponsor.

Uploading a Submission constitutes Entrant’s consent and grant to Sponsor and its affiliates, agencies, dealers, distributors, resellers, licensees, successors and assigns (collectively, the “Nikon Parties”) of a non-exclusive, worldwide, royalty-free, fully-paid, irrevocable, perpetual right and license to reproduce, modify, post, publish, edit, display and/or otherwise use Entrant’s Theme Video and/or Unedited Image (and/or Entrant’s name, city, state and/or likeness), in whole or in part, for promotional, marketing and/or publicity purposes solely in connection with the Contest, in any form, media or technology now known or later developed including but not limited to websites, social media pages, paid digital advertising, in emails, and/or at trade shows and events, without any compensation, notification, permission or other consideration, except where prohibited by law. If requested, Entrant will sign any releases and/or other documentation that may be required for Sponsor or its designees to make use of the rights Entrant is granting to use the Submission. Subject to the foregoing license, Entrant shall retain ownership of the copyright to the Theme Video and Unedited Image.

Theme Videos may be posted on the Contest Website for public viewing and to allow visiters of the Contest Website to indicate which Theme Videos they like, however, any such public comments or indicators are for entertainment purposes only and will in no way contribute to winner determination.

In the event of a dispute as to any Submission, the authorized account holder of the email address used to register will be deemed to be the Entrant and must comply with these Official Rules. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each Entrant may be required to show proof of being an authorized account holder.

6. Winner Determination: After the Contest Period, a panel of qualified judges determined by Sponsor in its sole discretion will select the three (3) Entrants with the highest-scoring Submissions out of a total of 100 points (the "Finalists") from among all eligible Submissions based on the following criteria (“Judging Criteria”):

  • Creativity/Originality (35 points);

  • Quality of Submission (35 points); and

  • Fit to Contest Theme (30 points)

The Finalist with the highest score based on the Judging Criteria will be deemed the potential Grand Prize winner. The Finalists with the Second and Third highest scores respectively based on the Judging Criteria will be deemed the respective potential First and Second Prize winners. In the event of a tie, the Entrant whose Submission received the highest score for Creativity/Originality, as determined by the qualified judges, in their sole discretion, will be deemed the applicable Finalist or potential winner. Sponsor reserves the right to select fewer than three (3) Finalists, if, in its sole discretion, it does not receive at least twenty five (25) eligible and qualified Submissions. Public comments or indicators of which Theme Videos are liked by visitors of the Contest Website will have no bearing on winner determination and will not be taken into account by the judges.

7. Winner Requirements: Potential winners will be notified by email, mail or phone on or around October 2, 2019. Except where prohibited, each potential winner (or parent/legal guardian if a minor in his/her state of residence) will be required to sign and return a Affidavit of Eligibility, Liability and Publicity Release and W-9 tax form, which must be received by Administrator within seven (7) days of the date notice or attempted notice is sent, in order to claim the prize. If a potential winner cannot be contacted, fails to execute and return the Affidavit of Eligibility, Liability and Publicity Release and W-9 tax form or provide any other requested information within the required time period, does not comply with these Official Rules, or a prize is returned as undeliverable, then the potential winner forfeits the prize. If a potential winner is disqualified for any reason, the prize may be awarded to a runner-up, if any, in Sponsor’s sole discretion. Only three (3) alternate winners may be determined, after which the applicable prize will remain un-awarded. Prizes will be fulfilled within eight (8) weeks after the end of the Contest Period.

Acceptance of any prize shall constitute and signify each winner’s agreement and consent that the Nikon Parties may non-exclusively reproduce, modify, post, publish, edit, display and/or otherwise use the winner’s name, city, state, likeness, Theme Video, Unedited Image, and/or prize information, in whole or in part, for promotional, marketing and/or publicity purposes and/or otherwise in connection with either the Contest and/or the Nikon Z-Series Camera, in any form, media or technology now known or later developed including but not limited to websites, social media pages, paid digital advertising, in emails, for in-store point of purchase videos, and/or at trade shows and events, without any compensation, notification, permission or other consideration, except where prohibited by law. If requested, Entrant will sign any releases and/or other documentation that may be required for Sponsor or its designees to make use of the rights Entrant is granting to use the Submission.

Each winner accepts and acknowledges that Sponsor shall not be obligated to use the Submission or any part thereof, and that Sponsor in its sole discretion shall have the right to refrain from using the Submission. Sponsor shall not incur any liability whatsoever to the extent Sponsor chooses to refrain from any exploitation of its rights hereunder. Each winner will indemnify Sponsor, Released Parties (as defined in Section 9, below) and any licensee of Sponsor against all claims, damages, liabilities, and expenses (including reasonable counsel fees and legal expenses) arising out of any breach of these Official Rules.

8. Prizes: ONE (1) GRAND PRIZE: A Grand Prize package, which consists of (a) one (1) Nikon Z 6 Filmmaker’s Kit, having an approximate retail value of $3,999.95, which includes the following components: one (1) Z 6 mirrorless camera body; one (1) NIKKOR Z-24-70mm F/4 S lens; one (1) Mount Adapter FTZ; one (1) Moza Air 2 3-Axis Handheld Gimbal Stabilizer; one (1) Moza Magic 11.8 Articulating Arm; one (1) Rode Videomic Pro+ Shotgun Mic; one (1) Atomos Ninja V 4K Recording Monitor with coiled HDMI cable; two (2) EN-EL 15B batteries; a one (1) year subscription to Vimeo Pro; and access to Nikon’s “The Art of Making Music Videos” online class (collectively, the “Z 6 Kit”); and (b) a cash amount of Twenty-Five Thousand ($25,000) Dollars. The total approximate retail value (“ARV”) of the Grand Prize is $28,999.95.

one (1) first place prize: A First Place Prize package, consisting of one (1) Z 6 Kit, and a cash amount of Ten Thousand ($10,000) Dollars. ARV: $13,999.95.

For all prizes: The actual value of the Z 6 Kit is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed.

Prizes are non-transferable and no substitution or cash redemption will be made except at the Sponsor’s sole discretion. Except for Sponsor’s limited warranty(ies), if any, included with any prize, all prizes are awarded “as-is” without any warranties or guarantees whatsoever of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. Sponsor reserves the right to substitute a prize or component thereof for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Limit: One (1) prize per person.

9. Release: By receipt of any prize, winners agree to release and hold harmless the Sponsor, the other Nikon Parties, Administrator, and each of their respective parent companies, subsidiaries, affiliates, suppliers and agencies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim, damage, losses, liabilities, causes of action, costs and expenses (including but not limited to reasonable attorneys’ fees) including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.

10. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. If terminated Sponsor may, in its sole discretion, determine the winners from among all non-suspect, eligible Submissions received up to time of such action using the judging procedure outlined above. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the Submission process or the operation of the Contest or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated Submissions. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including but not limited to attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Submission process or the Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Contest, the uploading, the processing or judging of Submissions or votes or the tabulating of votes, the announcement of the prizes or in any Contest-related materials; (5) late, lost, undeliverable, incomplete, invalid, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Contest or receipt or use or misuse of any prize (including any travel/activity related thereto). Released Parties are not responsible for misdirected or undeliverable Submissions or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third party use of any Submission.

12. Disputes: Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts located in Suffolk County, New York; (2) any and all of Entrant’s claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
